Extension of urgent civil protection interventions as a consequence of the exceptional meteorological events occurred in the days from 23 October 2023 to the first days of November 2023 in the territory of the provinces of Piacenza, Parma, Reggio Emilia, Modena, Bologna and Ravenna.

In order to support people and companies severely affected by the exceptional weather events from 23 October 2023 to the first days of November 2023, the measure to suspend mortgage instalment payments was adopted by Order No. 1,070 of the Head of the Civil Protection Department (OCDPC).

In particular, pursuant to Article 10 of the Ordinance, this event constitutes force majeure within the meaning of Article 1218 of the Civil Code.

By resolution of the Council of Ministers of 9 December 2024 – published on the website of the Department of Civil Protection and currently being published in the Official Gazette – ‘the state of emergency is extended for a further twelve months as a consequence of the exceptional meteorological events that occurred in the days from 23 October 2023 to the first days of November 2023 in the territory of the provinces of Parma, Reggio Emilia, Modena, Bologna and Ravenna’. The extension refers to art. 10 of the measure provided for in the Ordinance of the Head of the Civil Protection Department (OCDPC) of 12 February 2024, no. 1.070

Therefore, holders of mortgages relating to buildings that have been evacuated or declared uninhabitable, or managers of economic and commercial activities (including damaged agricultural land), who have requested and obtained the suspension of their mortgage instalments, (with the possibility of opting between the suspension of the entire instalment or only the capital portion) if – and for as long as – the uninhabitable or unfit for habitation of the buildings concerned continues, they may continue to benefit from the suspension granted, but not beyond the end of the state of emergency, which has been extended until 16 January 2026.

All further conditions governing the suspension of the mortgage still in place remain unaffected.
