Extensions of states of emergency due to the exceptional weather events in (i) Emilia Romagna from 20 to 29 June 2024, (ii) Piedmont on 29 and 30 June 2024 and (ii) Lombardy from 15 to 25 May 2024.

With the deliberations of the Council of Ministers of 14 July 2025 – published on the website of the Department of Civil Protection, the measures set out in the Ordinance of the Head of the Department of Civil Protection (OCDPC) of 13 August 2024, no. 1.095 – published on the website of the Department of Civil Protection – were extended by 12 months https://www.protezionecivile.gov.it/it/normativa/ocdpc-n-1095-del-13-agosto-2024/ – providing for the suspension of the payment of mortgage instalments, following the Resolution of the Council of Ministers of 7 August 2024 by which a state of emergency was declared for 12 months as a consequence of the exceptional weather events in the territory of the provinces of Bologna, Forlì Cesena, Modena, Parma, Piacenza and Reggio Emilia in the days from 20 to 29 June 2024.

In particular, Article 8 (“Suspension of mortgages”) of the Ordinance provided that the aforesaid event constitutes force majeure pursuant to and for the purposes of Article 1218 of the Civil Code. The same article provides that the holders of mortgages relating to the evacuated or uninhabitable buildings, or to the management of commercial and economic activities, including agricultural activities, carried out in the same buildings, or in the case of agriculture carried out in the landslide or flooded land, have the right to request from banks and financial intermediaries – until the aforesaid buildings are fit for habitation or habitable, and in any case not beyond the date of the end of the state of emergency, as in the case of agricultural land – a suspension of the instalments on the same mortgages, opting between the suspension of the entire instalment or only the capital share. The request for the suspension of instalment payments must be accompanied by self-certification of the damage suffered, pursuant to Presidential Decree No 445 of 28 December 2000 and subsequent amendments and additions.

Therefore, holders of mortgages that are in one of the above conditions and that have already benefited from the moratorium provided for by the Order, may request the extension of the moratorium until the agility or habitability of the property concerned and in any case not later than the date of termination of the state of emergency (in the case of agricultural land), opting between the suspension of the entire instalment or only the capital share, subject to the submission of self-certification of the damage suffered, pursuant to Presidential Decree No 445 of 28 December 2000 and subsequent amendments and additions.

All further conditions governing the suspension of the mortgage still in place remain unaffected.
