Faculty to apply for suspension of Mortgage Installment Payments for people affected by the emergency in Emilia Romagna

First urgent civil protection interventions as a result of the exceptional meteorological events that occurred, as of September 17, 2024, in the territory of the provinces of Ravenna, Forlì – Cesena, Rimini, Bologna, Modena, Ferrara and Reggio Emilia.

Declaration of State of Emergency. Faculty to request suspension of Mortgage Installment Payments. In order to support people and businesses newly and severely affected by the exceptional weather events that affected, starting from September 17, the provinces of Emilia-Romagna, following which the Council of Ministers on September 21 declared a state of emergency for 12 months, by Ordinance of the Head of the Department of Civil Protection (OCDPC) No. 1,100, the measure of suspension of mortgage instalment payments was adopted. Specifically, according to Article 8 of the Ordinance, this event constitutes force majeure under Article 1218 of the Civil Code. Therefore, holders of mortgages related to buildings that have been vacated or declared uninhabitable, or operators of economic and commercial activities (including damaged farmland), may apply for the suspension of mortgage installments, with the possibility of opting between the suspension of the entire installment or only the principal amount. The suspension is provided until the affected buildings are restored to habitability or habitability, and in any case no later than the end of the state of emergency. To apply for the suspension, customers will have to submit a self-certification of the damage suffered, in accordance with Presidential Decree No. 445 of December 28, 2000. Customers who, unfortunately, are in these conditions of severe hardship, have the opportunity to apply for the suspension of installments, within 60 days of the publication of the order in Official Gazette No. 227 of September 27, 2024. Below are the details regarding the technical procedures for requesting the suspension of mortgage payments:

• The suspension period also includes any overdue and unpaid installments (provided that the payment delay does not exceed 180 days from the request for suspension);
• The suspension becomes effective within 45 working days from the acceptance of the customer’s request; in the case of overdue and unpaid installments, the suspension applies starting from the first of these installments.
• Any installments that were overdue and paid between the occurrence of the event and the activation of the suspension are not included in the suspension.
• During the suspension period, the agreed contractual interest continues to accrue and can be reimbursed by the customer according to the following methods:

(i) Suspension of only the principal portion. The interest portion is repaid according to the original due dates; (ii) Suspension of amortization for both principal and interest portions, with the contractual interest rate applied to the remaining debt. In this case, the interest accrued during the suspension period is repaid (without additional interest) starting from the payment of the first installment following the resumption of amortization, with periodic payments (additional to the due installments and with the same frequency) for a duration to be determined by the bank based on the information provided by the borrower. Resumption of the amortization process at the end of the suspension period, with a corresponding extension of the repayment plan for a duration equal to the suspension period.
